I think there has been a misunderstanding.

The article talks about overturning the repeal of mandatory minimum sentences. Here’s my question, as someone who isn’t an expert: are mandatory minimum sentences essentially a way of increasing the punishment for those who, under the current legal system, would have received a lighter sentence than these mandatory minimums? So in practice, do they end up affecting those who, according to the current legal system, have committed less serious offenses?

This isn’t a discussion about the infallibility of criminology or the criminal justice system, but rather a question about what these mandatory minimum sentences consist of and to whom they are actually applied.

The problem with the mandatory minimum is that it captures for instance a 18 yo who takes a pic of his 17 yo naked gf and gets arrested for possession of csam, to do 1 year in your youth for that stuation would be unconstitutional, therefore a breach of your rights
