HYPOCRISY OF CHILDREN INCAPABLE OF SEXUAL CONSENT LAW

I my main blogpost and posts to this MAP forum I have contended that the legal criteria for pedophilia offences basically stands on a fraudulent, unscientific grounds, mostly similar to any religious doctrines like desecration or blasphemy. It basically stands on the presumption that “young people below a given age, say 18, are incapable of giving their informed sexual consent”, by the law. Therefore, adults having any sexual relation with them of whatever kind, would cause some unimaginable physical harm, damage and mental trauma, termed as child rape which devastates the child’s entire future life. Let me show how this established legal proclamation is basically fraudulent or unscientific.

ADRENARCHE
The first question to it is; if the children incapable of having or giving any informed sexual consent, what about the fact that shows, children right from the beginning of their prepubescent age called ADRENARCHE stage, indulge in sexual gratification or masturbation. What about the so many sex games they play in private, with themselves and children around their same age commonly known as doctor and nurse, touching, fingering, fondling each other’s genital? Do these children who indulge in sex with each other, do it without the consent of each other? This notion of sexual consent in children become meaningless and contradictory unless the stronger child forcing sex on the weaker child. This is usually called child upon child sexual assault or rape which perhaps happens many times. It suggests, children are very much capable of giving or withdrawing their sexual consent irrespective of their age. Is it because the authorities think sex does no harm to them while they are below 18, but sometimes they suddenly become incapable with someone who just passed over the age? Why this sudden appearance and disappearance of sexual consent that seems to happening in children below 18. I will deal into some examples on this point at the end of this essay while dealing over the pubescent or teen-age children. However, let me first start with the prepubescent children.

CHILDREN ARE SEXUALLY INNOCENT CLAIM
The proclamation that says “children incapable of sexual consent” also have an additional component that claims “children are SEXUALLY INNOCENT”. Guilty is the opposite of innocent. Therefore, what they are meaning is, children are incapable of knowing what sex is and whether it good or bad therefore does not FEEL ANYTHING GUILTY about it. They also add another phrase saying “children do not know the “Pros and Cons of sex”.

ADRENARCHE DEVELOPMENT IN PREPUBESCENT.
Contrary to the above anti-pedo presumptions, the scientific research on child sexuality reveals that prepubescent children from around the average age of 6 to 10 years become sexually aware and active due to their sex hormonal (Adrenarche) development. They become capable sexual arousal, desire and pleasure. Their daily routine of natures call often leads them into the curiosity and further exploring and playing with those parts or sharing with their playmates. Most probably they do it in some secluded place mainly because they feel guilty and afraid since they already know their parents don’t approve it. They have been perhaps signalled, admonished or punished for doing so. During this time or earlier, their parents compel them wear cloths in public start signalling them not to show those private parts outside because it, it is dirty, bad and they should be, to be ashamed of it. Children immediately understand their adults body language or verbal clues specially from their parents, guardians, teachers who don’t approve them showing interest in their sexuality. So they act accordingly, they learn to pretend, and lie in order to escape from the punishment and to get their adults approval and Favors for being a good child thus get indoctrinated.

PLAYING SECRET SEXUAL GAMES IN HIDING
However, when the children get the opportunity of playing in secret hiding places alone or with friends around their same age, they learn many things from each other. They instinctively know the secret sex games to be played in secluded places hiding from the preying eyes of their adults. Now their hidden sexual desires come to the forefront perhaps by some-ones more experienced introduced it, initiated them to the pleasures, if and when there are opportunities available. They may even make some secret plans to meet in a scheduled time and paces to do it and not to tell it to anyone else mainly because they very well know that their parents don’t approve it at all which makes them to feel guilty about it, as if they have committed something forbidden. This is the main reason why children begin to lie and pretend that they have never been interested in sexuality.

CHILDREN FAIRLY KNOWLEDGE OF PROS AND CONS OF SEX
Children fairly know the positive (pros) pleasure experience of sex and may start seeking it secretly waiting for the opportunistic movement. They also know the cons (consequences) mainly the disproval of their parents about it. A child may threaten the other child, telling what he or she did to their parents, to stop or make the other feel guilty and fearful of them. Of course, the very young children may not know about pregnancies however the modern age children learn it specially from their sex education classes event to the extent how to use condoms and birth control pills to prevent it. Many if not most (if not all) of the adults today have undergone above mentioned sexual experience during their childhood but feel guilty, ashamed or fearful to freely admitting it due to the social stigma attached to it.

SEXUAL STARVATION FRUSTRATIONS IN CHILDREN
During the period of their childhood, children undergo immense sexual repression and suppression. There are no proper avenue for their sexual outlet or any remedy to stop their sexual urges, except lesson on chastity, celibacy, virginity and other sexual virtue lessons. At this age children feel strong sexual attraction and desire to have sex with adults but don’t ever dare to express it. They undergo immense sexual starvation at this period but no one can legally help them on this matter. Even the prostitutes legally don’t allow them or they will be booked under child rape (readers perhaps familiar with media stories of pedophiles teachers) under the context of “CHILDREN ARE INCAPABLE OF GIVING INFORMED SEXUAL CONSENT”. Children are assumed to be having no significant sexual desire or attraction particularly towards the adults, claiming it totally harms them, irrespective of whatever the kind. They are not given any right to say and decide about their own sexual matter, cannot disagree protest and fight against the adults’ decisions. They are considered either as their parent’s private property or the state’s public property. The only right that the children are given is; SAY NO TO THE SEX. No one talks about the side effect of sexual starvation in children assuming it does not exist at all.

GENUINE CONCERNS OF ANTI-PEDO’S: CHILDREN ARE VULNERABLE NEED PROTECTION
I totally agree that there are some genuine concerns behind criminalising the child-adult sex as pedophilia. It stems from adults general knowledge of children whom they see as week, immature, incapable of knowing it harms them like alcohol, tobacco etc., so it should be prohibited by law. Therebefore, any adults manipulating vulnerable children for sex generally known as child grooming should be treated as a serious crime. However, in reality, child grooming happens in every stages of children’s development throughout their life by their culture, tradition, education, religion, or other activities and belief systems. Of course, I agree that the belief in God in the general public does many great goods things to the society, by preventing lots of crimes under their religious doctrines. Therefore, they believe abandoning the belief in God will make people to become all kinds of criminals including the pedophiles. CHILDREN CAN BE HIGHLY CAPABLE
However, in reality we see children being very much capable of deciding what they want and what they don’t, whether they consent or don’t consent. Their decision is perhaps far stronger than many of those adults. It is not essay to persuade children to do something that would harm them. Their protest against any such adults even parents far louder and effective and there are always the other adults around to protect them. The only thing that wins a child’s confidence is when someone comes at the times of their needs of love and affection helps them teaches them, plays with them, showing concerns in their difficulties and supporting them while being neglected by the other adults around. They could be is mostly the child’s own parents or their guardian, teachers, mentors or friends but seldom strangers. Therefore, adults who were branded as pedophiles mostly happens to be someone in the name list mentioned above. What is most important rule to prevent the abuse of children is, there should be no threat or coercion, to making children to agree, pressuring them to say or do against their will by the adults who holds authoritative position over them under whom the children feel helpless.

PEDOPHILIA DIAMETRICALLY OPPOSITE OF ITS MEDIA PORTRAYALS
Pedophilia is quite contrary to its main stream media portrayal and narratives, diametrically opposite to those people who commits violence against children, abusing, beating subjecting to pain, cruelty, torture to mentation and terror even murder. The great irony of the fact today is that the so-called child right advocates equate those cruel brutal child rapist murderers to the loving kind people towards children as pedophiles most probably to divert the attention knowingly or unknowingly from the real cruelty sufferings and abuse of millions of children around the world. HYPOCRISY OF SEXUAL CONSENT IN CHILDREN.
Now let us go back to main anti-pedo establishments hypocritic dogma that proclaims that “children incapable of sexual consent”. Let us go back to the starting example of sexual relation between a 14 and 15year old. Nobody dares to call them as pedophiles or book both under child rape because their sexual relation is not considered as wrong (like smoking cigarettes or driving without license, or drinking alcohol). Now suppose one of the two forces sex on the other. When reported the authorities immediately consider, it is a rape because ONE OF THEM NOT CONSENTED to that sex. Now where did this sexual consent in these two children below 18, suddenly appeared from? Let me continue with the same case of 14 and 15 years old who continue their sexual relations without any such problem. In three years, one become 18 while the other is still 17 years. Will all a sudden the children incapable of giving informed sexual consent appear from one side and disappeared from the other side? Can the 18 year old become a pedophile, child rapist as soon and the 17 year old become a victim at once? Does it make any logical, rational or objective sense?

CONCLUSSION
All I am trying point out in this mini paper is, the prevalence of present-day hypocrisy of criminalization of pedophilia under the pretext of children below a certain age are incapable of giving their sexual consent therefore, any sexual relation with them at this age by the adults constitutes a child rape, by law. It has devastated hundreds and thousands of innocent people, branding and registering them as child sex offenders or rapists. Now, let me conclude it in short; in my opinion first of all, any reasonable age definition, determining the age of children remaining incapable of giving their sexual consent makes very little sense, if any at all, in the present social and scientific context. The sexual modesty, honor, respect for both the men and women should be equally applied generally as the same irrespective of their age or gender. Most importantly any serious crime should be determined by its intention of causing objective physical harm, loss, injury pain mental trauma torment, abuse, cruelty, torture, murder or causing deaths or murders also the number of human lives involved. Quilty and quantity of child abuse, neglect, abandonment should be given the priority in determining the seriousness of the crime opposite of the subjective, cultural, moralistic, religious values of feeling offended and victimhood. Therefore, in short, any sexual misconduct sexual consent, rape should be brought generally under the same common criminal law based on definite objective scientific evidences and not on the subjective feeling of victimhood.

I had a debate with someone recently after they raised the subject of something in the press that was doing the usual pedo bashing and so I asked them to think about what they had just said, specifically think about their own statements and what they mean. She started to go through them and by the second statement it dawned on her and she just said she didn't want to talk about it any more, end of conversation. It was such a visible example to me of someone who said something because she has been trained to say it, but when pushed to think about the logic of it she is quickly confronted with the irrational nature of those statements and has no where to run except to end the conversation and pretend it never happened.

That's where many people are at. They haven't thought about it, they've just been spoon fed over a long period of time to accept something as factually true, but when walked through the logic the walls quickly come crashing down.

Most important of all, we must build our legal argument on the scientific grounds to repudiate their fraudulent dogma showing it continues to destroy millions of innocent people accused of child sexual assault or rape. Believe me, the progressing AI technology is on our side.

There is a need to challenge legal arguments and now is a good time to do that.

Prisons are expensive and over capacity in many countries forcing countries to rethink how the deal with issues such as cp. I have spoken to an ex-prison warden who said she believed that prison is no place for people caught with cp, they clog up the system and gain nothing from being in prison and just create dangerous situations for prison officers. I've spoken to several legal experts who also believe prison is not the right way to deal with many people charged with "lesser crimes" related to being pedophile. There is definitely a lot of support from inside the system including from some judges. I followed one case where the judge was highly critical of the prosecution for how they were presenting a case as deserving the courts time.
