I am not arguing for the abolition of statutory age of consent law. Instead, I suggest that we need to look closely and critically at the types and the degree of harm the age of consent law claims to avoid and punish. In light of the harm principle, criminal law should not punish ‘harmless immorality’. In an advanced liberal polity, we cannot agree on more than a minimum of allegedly uncontroversial values. The complex relationship between law and culture or sexual mores is particularly important in the realm of criminal law, which involves the moral condemnation of an act by punishment.
