The First Amendment protects an individual’s right to privately possess images or videos of child pornography created using artificial intelligence — if the material does not depict a real person and remains in the home, a federal appeals court judge ruled Tuesday

This only applies to possession, not production or distribution, so in practice you can still be imprisoned for having AI made CP if you used a local model to create it(production) or sent it over the internet(distribution).
It's a pretty narrow loophole.

Yeah but its still a good start for any debate about CP laws
