My issue with all these states putting the death penalty on the table is it could actually make it worse. If the abuser knows the death penalty is an option, who's to say they won't take the chance of killing the child and dispose of the body? Sort of a "kill the witness" frame of thought.

That's true. Also, I think harsher sentences contribute to this climate where abuse gets underreported. Who is going to snitch and potentially kill someone? Not everyone is in this frame of mind ("sex offenders deserve to die").
