A Middlesex Superior Court judge on Thursday acquitted former Lowell High athletic trainer Damon Amato of an indecent assault and battery charge stemming from allegations that he inappropriately touched a student athlete while treating her for an ankle injury more than eight years ago.
Amato, of Northboro, had been accused by the now 25-year-old woman — who testified for more than three hours during the trial — of massaging her buttocks and then asking her to remove her shorts, leaving her in her underwear, inside a training room at Cawley Stadium while another younger student was present.
Defense attorney Claudia Lagos argued during her opening statements that the contact was part of a legitimate athletic training assessment “by a seasoned athletic trainer who worked at Lowell High School for almost two decades” and denied that the student was ever asked to remove her shorts.
Judge Kenneth Salinger, while calling some of Amato’s actions that day “disturbing,” ultimately ruled him not guilty of one count of indecent assault and battery on a person 14 or older.
