The Government has been urged to ban online pornography glorifying or promoting child sex abuse.

In a Committee Stage debate on the Crime and Policing Bill in December, Peers called on the Government to clamp down on extreme online sexual content depicting children.

Amendments to the Bill tabled by Conservative Peer Baroness Bertin, to end what was described as an “indefensible” stain on our society, received support from across the chamber.

1ZA Offence of encouragement to sexual activity with a child or family member(1) It is an offence to produce or distribute any written material, visual representation or audio recording that glorifies, advocates or counsels sexual activity that would be an offence under the Sexual Offences Act 2003 either with—(a) a person under the age of eighteen years, or(b) a family member, where “family member” has the meaning set out in section 27 (family relationships) of the Sexual Offences Act 2003.

Soon it will get to a point where British MAPs just say "fuck it", and decide to do whatever the hell they want.

"Glorify" appears to have an extremely vague meaning under UK law. The title of the offense, and its content, do not say the same thing.

This could be applied to any comment such as on the Daily Mail comment sections, flippantly exclaiming that a teenage boy's fling with his teacher was the "best day of his life".

From UK terror law, which defines "glorification":

“glorification” includes any form of praise or celebration, and cognate expressions are to be construed accordingly

Under terror law, glorification is only a crime with a caveat. It requires that:

what is being glorified is being glorified as conduct that should be emulated by him in existing circumstances.

To "glorify" terrorism, there must be an element of incitement. However, the anti-MAP amendment being proposed has no such caveat. Therefore, "any form of praise or celebration" of AMSC is likely to become a child sex offense should this amendment pass. No incitement is required.

If you say "AMSC is beautiful!", you have committed a crime.

Justice Minister Baroness Levitt responded that the Government would not be supporting Lady Bertin’s amendments, but recognised her tireless work seeking to raise “awareness of the ways pornography shapes sexual behaviour” and pledged to work with her “in the coming weeks”.
