(Seoul = News1) Senior Reporter Park Tae-hoon = Supreme Court Chief Justice nominee Cho Hee-dae explained that his 2017 ruling, which acquitted a 40-year-old entertainment agency CEO who impregnated a middle school student 27 years younger than him, was made "to uphold the legal system."
During his confirmation hearing at the National Assembly on the afternoon of the 5th, Cho was questioned about a past ruling from his tenure as a Supreme Court justice. In 2017, he upheld the acquittal of a 42-year-old entertainment CEO accused of raping a 15-year-old middle school student.
Democratic Party lawmaker Jeon Yong-gi brought up the case, asking, "Can our society accept this?" He criticized the ruling that recognized the CEO's claim of being in a "romantic relationship" with the 15-year-old, stating, "I absolutely cannot agree with a ruling that acknowledges 'love' in such a case."
Jeon further questioned Cho, asking, "Isn't it the law's duty to prevent 'grooming crimes,' where perpetrators manipulate and control their victims psychologically?"
Cho responded, "Since no new evidence was presented in the retrial after the case was sent back for review, we had no choice but to rule not guilty. The decision was based on the principle of legal binding force, not a judgment on the merits of the case itself."
When Jeon criticized him, saying, "For a case with such significant societal repercussions, shouldn't the court have reviewed the substance of the case rather than merely following procedural rules?" Cho replied, "There is always a conflict between specific fairness and legal stability. If we start disregarding procedural rules when cases are sent back for retrial, the entire judicial system will collapse."
In essence, Cho argued that because the case had already been ruled not guilty in a previous Supreme Court decision and was sent back for retrial, the court had to maintain that ruling to preserve the legal system.
The case in question dates back to 2011.
At the time, 42-year-old entertainment agency CEO Cho was involved in multiple sexual encounters with a victim 27 years his junior. After the victim became pregnant and ran away from home, he brought her to live with him.
After giving birth, the middle school student reported Cho to the police in 2012, leading to his indictment on charges of violating the Act on the Protection of Children and Adolescents from Sexual Abuse (rape, etc.).
Cho denied the charges, claiming, "It was a consensual relationship, not rape." However, the first trial sentenced him to 12 years in prison, and the appellate court reduced the sentence to 9 years.
Cho appealed, and in November 2014, the Supreme Court overturned the guilty verdict and sent the case back to the Seoul High Court. The court cited evidence such as letters the victim sent to Cho while he was incarcerated, which included messages like "I love you," as well as frequent affectionate messages exchanged via smartphone messenger.
Following the Supreme Court’s reasoning, the Seoul High Court also ruled Cho not guilty. Prosecutors appealed the retrial decision, but on November 9, 2017, the Supreme Court’s second division, presided over by Justice Cho Hee-dae, finalized the acquittal.

She claims LGBTQ+ rights need to be restricted to "protect kids," but she appointed a man who admitted to having sex with a minor to a high-level position.
Arkansas Gov. Sarah Huckabee Sanders (R), who has repeatedly pledged to “protect kids” with anti-LGBTQ+ laws, appointed a man to a top state prison post even though he had previously been fired from a local police force for receiving oral sex from a teen girl in a post office parking lot.
Jamol Jones, who Sanders appointed as chairman to the Arkansas Post-Prison Transfer Board in January, resigned last Friday after news agencies reported that the Benton Police Department fired him after he admitted to an internal affairs investigator that he had sexual relations as an adult with a 17-year-old girl, the Arkansas Democrat-Gazette reported.
The age of consent in Arkansas is 16. A ban on gender-affirming care for trans minors that Sanders signed last year includes everyone younger than 18.
A November 1, 2018 letter from Benton Police Chief Scotty L. Hodges revealed that he placed Jones on administrative leave with pay “until further notice” for lying to an internal affairs investigator about his sexual relationship with the teen. Jones said he lied because he was embarrassed and scared. An investigation found that Jones’s initial job application to join the police force “did not provide or submit certain key information” about the relationship with the minor.
Jones said he and the girl “had talked at the gym” and that “she had identified herself as an 18-year-old” before performing oral sex on him in the Benton Post Office parking lot. Though he denied knowing her actual age, the Benton Police internal affairs investigator wrote in his official report, “There was indication he knew her age and continued the relationship, even telling her that the relationship could not be found out.”
Jones admitted to wanting to keep the relationship secret. He also admitted to never asking to see the girl’s ID, even though he had been formerly trained as a police officer to confirm people’s ages by doing so. The girl’s mother said she suspected that her daughter might have lied about her age to attract male attention, and the mother added that she didn’t want Jones to go to jail over the sexual relationship with her daughter.
Nevertheless, the lie and relationship violated the department’s ethics policy and state law. Though the Saline County prosecuting attorney’s office didn’t file charges against Jones, Hodges fired Jones three weeks later.
When Sanders appointed Jones in January, she said in a statement, “His prior law enforcement experience makes him a clear choice to take on this important role, and I look forward to working together as we empower Arkansans with a safer, stronger state.”
He was meant to serve for seven years as the board’s “chief executive, administrative, budgetary, and fiscal officer” while earning an annual salary of over $95,380. The board he resigned from oversees parole, alternative sentencing programs, and expunging criminal records for eligible offenders.
State Sen. Kim Hammer (R) said that he and other senators “had no knowledge of [Jones’s] actions” before the Senate voted to confirm his appointment to the position, noting, “I was given no indication from the Governor’s office, who vets the application, that there was an issue.”
Sanders’s office didn’t respond to a media request asking if she knew of Jones’ firing from the police force before she appointed him or how her office vets potential political appointees. Her appointment of him seems at odds with her pledge to “protect kids” by passing anti-LGBTQ+ legislation.
In March, Sanders also signed a “Don’t Say Gay” law, banning classroom instruction on gender identity and sexual orientation before fifth grade, as well as another bill allowing anyone who received gender-affirming care as a minor to sue their doctor up to 15 years after they turn 18 — though a court blocked it. In February, she signed a bill reclassifying drag performances as adult-oriented entertainment.
“The Governor has said she will sign laws that focus on protecting and educating our kids, not indoctrinating them and believes our schools are no place for the radical left’s woke agenda,” a Sanders spokesperson said in a statement when she signed the gender-affirming care ban.
Last November, Sandres appointed an anti-LGBTQ+ Christian nationalist to oversee state libraries. In October, Sanders issued an executive order banning “woke,” gender-inclusive language in government communications.

BILLINGS - A purported militia member from Billings who was arrested following a standoff in Livingston appeared for arraignment Friday in Yellowstone County District Court on charges of child sexual abuse.
Timothy Allen Westervelt, 34, appeared in court by video from the Yellowstone County jail and entered not guilty pleas to two counts of felony sexual abuse of children (16 years or younger), and one felony count each of sexual intercourse without consent (inflicts bodily injury or victim less than 16 offender 4 years older) and sexual abuse of children (possession of material).
A judge set bond at $250,000 after hearing details from a prosecutor about how Westervelt was arrested recently with a firearm in Livingston following a standoff with law enforcement. The judge ordered Westervelt to have no contact with minors, including a 13-year-old identified as the sexual abuse victim.
A prosecutor at the hearing said Westervelt learned of the arrest warrant related to the child rape charges on Monday evening and called law enforcement threatening suicide. He was located the next day at a coffee shop in Livingston and barricaded himself in the business while armed with a handgun. Authorities successfully evacuated the store and a nearby grocery and people inside a nearby hotel were ordered to shelter in place until Westervelt eventually surrendered and was arrested.
Westervelt recently identified himself to Q2 News as a member of the Yellowstone Militia, a group "dedicated to constitutional militia," according to its website.
"All law abiding Men and Women are welcome, regardless of circumstance," states a portion of the group's mission statement.

The widow of ex-Home Secretary Lord Brittan, who was falsely accused of being part of a paedophile ring in Westminster, has criticised the decision to drop an investigation into the officer who led an inquiry into the claims.
Lady Brittan said the misconduct proceedings against Met Police officer Steve Rodhouse had been "quietly dropped".
She told BBC's Emma Barnett it showed a "complete lack of professionalism" and that her trust in the Met and the police watchdog that led the investigation had been "severely undermined".

A South Carolina Republican lawmaker — who once preached about the importance of safeguarding children from unnecessary harm — is accused of distributing more than 200 files of child pornography online while using the screen name “joebidennnn69,” federal prosecutors alleged.
Robert “RJ” May, 38, a member of the House of Representatives in the Palmetto State, was arrested at his Lexington County home Wednesday on a 10-count indictment charging him with distributing child sex abuse material, court documents showed.
The married father of two used “joebidennnn69” and several other user names to exchange 220 obscene files containing extremely graphic footage of children and toddlers engaged in sex acts on the messaging app Kik over five days last spring, federal prosecutors alleged.
The three-term rep allegedly downloaded the sickening files on his home Wi-Fi network and cellphone, prosecutors said, noting that some files were hidden using a private network while others were directly linked to his personal IP address.
Lawyers for May suggested at his arraignment that someone else could have been using his WiFi password to procure and share the twisted images.
Officials launched their investigation after the social app flagged suspicious activity to the National Center for Missing and Exploited Children in April 2024.
Homeland Security agents searched May’s house in August 2024 and seized nearly three dozen electronic devices from his home, including a laptop, a tablet, four cell phones, four hard drives, and 19 thumbdrives, The State reported.
On one of those seized devices, May allegedly kept several videos of himself on trips to Colombia engaging in sex with three women who appeared to be underage and were paid, a DHS official testified.
Prosecutors asked that May not be given bail because his two children are the same age as those who were exploited in the illicit material.
May, first elected in 2020, founded the House Freedom Caucus in the state as part of a hard-line conservative movement that ran to the right of many Republicans, according to The State.
The House Freedom Caucus expelled May on Wednesday following his arrest with former allies now calling on him to resign from his position in the state house, that report stated.
The congressman was a vocal advocate for pet conservative causes such as protecting the family.
“We as legislators have an obligation to ensure that our children have no harm done to them,” May said in January 2024 during a debate on transgender care for minors, just months after his house was raided by feds.
He was ordered to remain in jail until his trial.
Each charge carries a five-to-20-year prison sentence.
